Have you ever been driving on the highway and found yourself behind a loaded down pick-up truck that didn't seem safe? The cargo can be anything including ladders, lawn chairs, blocks, construction debris, grills, and mattresses. Or you've had to swerve trying to evade the debris.
Drivers are often the ones held liable for a loose cargo collision. They may argue that someone else loaded the cargo in their truck. For example, if they purchased an item and someone from the store loaded it into their truck, however. It is still the driver’s responsibility to make sure it is safe to be on the road. What does the DOT, AAA, and NHST have to say?
DOT - The US Department of Transportation has designated June 6th as "Secure your Load" day along with 40 States. Drivers with unsecured debris that injures or kills someone can be charged with vehicular homicide. They can be sued in civil court for personal injury and/or wrongful death.
AAA debris-related crashes
According to a AAA report, from shredded tires to a sofa sitting in traffic lanes, roadway debris caused more than 200,000 crashes with 500 deaths over four years across the USA. More than one-third of the deaths resulted from a driver swerving to avoid hitting debris. In other cases, cars struck the debris, sometimes setting off a chain-reaction of collisions.
National Highway Traffic Safety NHTS - “Each year, about 730 people are killed and 17,000 more are injured because of objects in the road. Most of these crashes (81%) involve unsecured loads on passenger vehicles.”
